These Terms & Conditions (“Terms”) govern your use of whitebucketdesigns.com (the “Site”), operated by White Bucket Designs (“White Bucket,” “we,” “us” or “our”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Website information is not a client engagement
The Site introduces our point of view, process and services. Site content is general information and inspiration only. Visiting the Site, sending an inquiry or participating in a complimentary Fit Call does not create a designer-client, advisory, fiduciary or other professional relationship and does not obligate either party to proceed.
2. Paid services require a separate written agreement
Any project begins only after the parties sign a proposal, agreement or other written scope and satisfy any stated payment or scheduling requirements. That agreement controls the project’s scope, fees, purchasing, intellectual property, confidentiality, photography, revisions, cancellation, warranties, liability and dispute terms. If these Site Terms conflict with a signed client agreement, the signed client agreement controls for that project.
3. No technical, safety or regulated advice
Site content is not architectural, engineering, surveying, appraisal, conservation, construction, code, permitting, legal, tax, financial, health or safety advice. Do not rely on photographs, diagrams, dimensions, product references or general observations as a substitute for site-specific work by an appropriately licensed or qualified professional. Verify measurements, conditions, load limits, installation requirements, codes and product suitability before acting.
4. Intellectual property and trademarks
The Site and its original text, photography, graphics, logos, layouts, method descriptions, service names, downloads and other content are owned by or licensed to White Bucket Designs and are protected by copyright, trademark and other laws. Client-owned objects, third-party artwork and third-party marks remain the property of their respective owners.
White Bucket Designs™, The White Bucket Method™, The Room Edit™, The Room Plan™, The Curated Room™, The Room Realized™, The Collected Home™, Make Room for What Matters™, and Collected. Curated. Not Decorated.™ are trademarks or claimed marks of White Bucket Designs. Use of the ™ symbol does not represent that a mark is federally registered. No license or ownership right is granted by access to the Site. Do not use our names, marks, logo, method, imagery or confusingly similar branding without prior written permission.
5. Limited permission to use the Site
We grant you a personal, limited, revocable, non-exclusive and non-transferable right to view the Site for lawful, noncommercial purposes. You may not reproduce, republish, sell, scrape, frame, modify, distribute, train an artificial-intelligence system on, create derivative works from, remove rights notices from, reverse engineer, interfere with or exploit Site content or technology without written permission, except where applicable law expressly permits otherwise.
6. Information you send
You represent that information, photographs and materials you send are accurate to your knowledge and that you have the right to share them. Do not send unlawful, infringing, confidential third-party or sensitive personal information. You grant us a limited license to receive, copy and use submitted materials only as reasonably necessary to evaluate your inquiry, communicate with you and perform an agreed project. Public use of client project materials or photography requires the permission described in the applicable client agreement or a separate release.
7. Third-party products, professionals and links
References or links to products, vendors, trades, social networks or other third parties are provided for convenience and do not create a guarantee or endorsement unless expressly stated. Third parties control their own availability, pricing, measurements, materials, color variation, workmanship, delivery, installation, returns, warranties, privacy and terms. White Bucket Designs is not responsible for third-party sites or acts, omissions, delays or products, except to the extent a signed client agreement expressly provides otherwise.
8. Site availability and disclaimer of warranties
To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability or freedom from harmful code. Images and screens may display colors, scale and materials differently from physical reality. We may change, suspend or discontinue any part of the Site without notice.
9. Limitation of liability
To the fullest extent permitted by law, White Bucket Designs and its principals, personnel and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages; lost profits, data, goodwill or opportunities; or losses arising from reliance on Site content, inability to use the Site, third-party conduct or unauthorized access. Our aggregate liability arising from the Site will not exceed the greater of $100 or the amount you paid specifically to access the Site during the twelve months before the claim. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited. Liability relating to paid services is governed by the signed client agreement.
10. Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless White Bucket Designs and its principals and personnel from third-party claims, damages, liabilities and reasonable costs arising from your unlawful use of the Site, your violation of these Terms or materials you submit without sufficient rights. This provision does not require indemnification for our own fraud, willful misconduct or gross negligence.
11. Governing law and disputes
Colorado law governs these Terms, without regard to conflict-of-law rules. To the extent permitted by law, disputes relating solely to the Site must be brought in a court of competent jurisdiction in Colorado, and you consent to that jurisdiction. Before filing a claim, the parties agree to make a good-faith effort to resolve it informally by written notice and thirty days of discussion. This section does not prevent either party from seeking emergency injunctive relief for misuse of intellectual property or confidential information.
12. General terms
If a provision is held unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them in connection with a business reorganization or transfer. Headings are for convenience only.
13. Changes and contact
We may update these Terms by posting a revised version and changing the “Last updated” date. Continued use after an update constitutes acceptance of the revised Terms. Questions, permissions requests or notices may be sent to hello@whitebucketdesigns.com.
These Terms are a business-ready draft intended to reduce avoidable website risk. They should be reviewed by qualified Colorado counsel and coordinated with the final client proposal and agreement before commercial launch.
